According to Kasidiaris’s lawyer, Vaso Pantazi, the council’s decision cited the pending case concerning alleged electoral fraud, in which 11 Spartans party MPs, along with Kasidiaris as the alleged instigator, are facing charges. Pantazi argued that Kasidiaris is being kept in “a peculiar form of detention” over what she described as a “minor case” involving misdemeanour charges.

Kasidiaris, who appealed to the Lamia Misdemeanor Council for release, argued that he has already completed the portion of his sentence related to his Golden Dawn conviction. He has also taken his case to the European Court of Human Rights, challenging what he claims is a violation of the presumption of innocence.

“We have a first-time convict who has already completed his sentence and is not being released. An appeal has also been submitted to the European Court, as his presumption of innocence is being disregarded,” Pantazi stated.
