A 45-year-old businessman who was driving under the influence when he crashed into another vehicle, killing 22-year-old Panagiotis, was sentenced to prison on Wednesday, January 15, following his plea before an investigating judge. The defendant had been charged with dangerous driving under the influence of alcohol resulting in death, a felony under Article 209a of the Greek Penal Code, as well as other offenses. Meanwhile, three traffic police officers in Chania who conducted a breathalyser test on the defendant but gave the keys to his friend and let him leave with the car, have been suspended and will remain off duty until the completion of a sworn administrative examination into their conduct.
Four times over the alcohol limit
Toxicology reports confirmed that the 45-year-old had an alcohol level four times over the legal limit, rendering him unfit to drive. The court proceedings were attended by the father and twin brother of the victim, who had been following the case closely.
During his statement, the businessman apologised for the events of that night and expressed remorse, claiming he wished he had been in Panagiotis’ place instead.
However, the victim’s father dismissed the apology, stating:
“No one from his family has contacted us, and at this point, the apology is nothing more than a formality.”
He added:
“What does it mean that he would have preferred to be in my son’s place? I certainly would have preferred to be in my child’s place.”
Calls to change charge from negligence to intent
Following the ruling, Panagiotis’ father welcomed the pretrial detention of the defendant but vowed to push for a more severe charge.
“The first step has been taken. Of course, this was self-evident. But we will not stop here. The charge was negligence, which carries a sentence of 10 to 12 years. We want it changed to homicide with possible intent. That will be our next move, and I will do whatever is necessary to ensure it happens. We will take legal action against all those responsible.”
He also criticised authorities over the handling of the case and remarked on the decision to remove the Chania Police Department from the investigation, stating:
“Those who need to do their job—the ones high up—must step up.”
New charges after toxicology results
The businessman now faces additional charges after toxicology results revealed he was also under the influence of antipsychotic drugs at the time of the crash.
According to ERT, this new prosecution adds to the original felony charge of dangerous driving under the influence of alcohol causing death.
