The prosecutor had argued against Michaloliakos’ release, citing his unrepentant nature and continued assertions that he was a victim of political persecution. These concerns were highlighted through extensive articles and statements made by Michaloliakos from prison. However, the Judicial Council ruled that any doubts regarding Michaloliakos’ potential risk should work in his favour, ultimately deciding his conduct in prison justified a conditional release.

As part of the conditions for his release, Michaloliakos is prohibited from leaving the region of Attica, must report monthly to the police station in his area of residence in Pefki, and is forbidden from associating with any co-accused from the cases for which he was imprisoned. These measures aim to mitigate the risk he poses while adjusting to his conditional freedom.
