The recommendation concerns Korkoneas’ request for the recognition of a mitigating circumstance related to prior cohabitation, which had been rejected by the Lamia Mixed Court of Appeal. Following that decision, Korkoneas was sent back to prison. The case has now returned to the Supreme Court for a third time after he lodged a further appeal.

During the hearing, the lawyer representing the victim’s family, Zoe Konstantopoulou, sought to submit a memorandum. The defence lawyer for Korkoneas, Vasso Pantazi, argued that the submission of a civil action was not examined at this procedural stage, citing the need for institutional safeguards and rejecting claims of immunity.

After a brief adjournment, Konstantopoulou stated that the mother of Alexandros Grigoropoulos wished for the case to reach a final conclusion. She also complained that insults and threats had been directed at her during the second-instance proceedings and alleged that behind-the-scenes mechanisms had been activated.

Responding to these remarks, the president of the court noted that previous judicial decisions had already resulted in the rejection of the disputed mitigating circumstance.

The defence of Epaminondas Korkoneas then presented its arguments in support of overturning the Lamia Court of Appeal’s ruling on the non-recognition of the mitigating factor.
